Dear Parent or Guardian:

I am emailing today, to make you aware of a recent court case in which the California Department of Education (CDE) has been ordered by the courts to release all student data that the CDE has collected on general and special students since January 1, 2008.  As a parent/guardian you have the right to object to the disclosure of your child’s protected personal information and records by notifying the court in writing by April 1, 2016.  To notify the courts, download the Objection to Disclosure of Student Information and Records form on the CDE website: and mail it to the court by April, 1, 2016.  (The return address and instructions are on the bottom of the form.)

Mt. Diablo Unified School District was not involved in the lawsuit, nor is it the subject of any of the suit’s allegations.  Mt. Diablo Unified School District is not involved in this release of data, nor in the collection of the Objection forms.   Also of note, Mt. Diablo Unified School District does not identify students by social security numbers; instead, Mt. Diablo Unified School District uses a state-issued unique student identification number.

This case started in April, 2012, when two organizations, the Morgan Hill Concerned Parents Association, and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws.  The suit also alleges the CDE fails to monitor, investigate and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation.

For more information regarding the release of this data and how you can file an Objection to Disclosure of Student Information and Records form with the court to consider not releasing your child’s data, visit here You may also contact the CDE at (916)319-0800.
